PERSONAL DATA CONFIDENTIALITY POLICY

The purpose of this privacy policy (hereinafter the "Charter"), in respect of privacy, is to formalize our commitment to respect the privacy of users of the website www.corthay.com (hereinafter the "Site") operated by our company MAGE SAS with a capital of €5 687 855, 1, rue Volney, 75002, Paris

Conforming to the provisions of our Site, we will process your personal data in accordance with General Data Protection Regulation 2016/679 of 27 April 2016 ("GDPR") and in compatibility with the conditions set out below.

This Charter and the General Terms and Conditions of Sale, available on our Site, form a contractual whole. All capitalized terms not defined in this Charter are defined within our General Terms and Conditions of Sale.

Personal data refers to any information relating to an identified or identifiable natural person. We collect and process personal data within the context of the provision of our Products or the communication about these Products exclusively, in strict compliance with the GDPR.

We only collect personal data that is adequate, relevant and limited to what is necessary for the purposes for which they are processed. Thus, you will never be asked to provide information on personal data considered "sensitive", such as your racial or ethnic origin, political, philosophical or religious opinions.

By registering on the Site, you authorize us to process your personal data in accordance with the Charter. If you disagree with the terms of this Policy, please do not use this Site or its Services.

 

  1. What types of information do we collect?

 

Connection data

Each time you connect to our Site, we collect personal data such as, but not limited to, your IP address and MAC address of your computer, the date and time of the connection, and information about the browser you are using.

Navigation data

We also collect information to identify how you accessed the Site, which pages you visited and for how long.

Personal data collected from your Customer account

When you create a customer account on the Site we collect personal data provided by you, such as, but not limited to, your first and last name, email address, gender, date of birth, postal address and telephone number.

 

Data related to your orders and payments

If you buy anything on our Site, some data, such as your telephone number, delivery address and billing address, will be collected for the purpose of processing your purchases and payments. In light of this, you agree that we may use external service providers who may collect personal data. This is for the purpose of enabling the proper functioning of credit card payment processing services or any other means of payment and, where applicable, the delivery of Products. We keep details of your payments, as well as details of the purchases you make. Transaction details are kept either in our systems or at the external service provider. This retention is for internal purposes, including accounting, compliance and legal purposes.

Please note that your credit card details are only used to process your payment and are not stored.

Communications

When you communicate with Corthay via email or the contact form on the Site, Corthay keeps a copy of your messages as a background record to help the company respond to you as efficiently as possible.

Personal data collected automatically

Corthay automatically collects information on how you use our Site; in particular, information concerning your search history, the pages you visited, the dates and times of your visits and the content of third party sites that you have used. Corthay also collects information provided by your computer, smartphone or tablet on your use of the Site, such as the relevant browser, your device, the browser language, the IP address or your mobile phone operator.

Tracking information

Corthay will know where your device is if you activate the location function via your browser or portable device. Corthay can deduce your general location from your IP address. You will also be sharing your location with us when you give us your postal address at the time of opening your customer account or by giving us your delivery and/or billing address when you place an order.

Surveys, competitions and promotions

If you take part in surveys, competitions or promotions offered by Corthay, any personal data you provide will be collected.

Subscribing to our newsletter

If you would like to be included in our mailing list and receive our newsletters, please tick the relevant box in order to opt in. If you would rather not receive newsletters from us, you can opt out by clicking on the unsubscribe link in the newsletter or through your customer account if you have one .

2. Use of data

 

We collect your data to be able to:

- manage your customer account online;

- manage the orders and payments you place on the Site;
- improve your customer experience on our Site (e.g. by customising the content and information we make available to you);

- analyse visits to the Site and learn more about the interests of our visitors in general;

- conduct a competition, promotion, survey or other function on the Site and provide you with appropriate products and services (e.g. to offer you a prize you may have won in a competition, we would contact you by phone or email);

- send you information via email on our Products, special offers and news that may interest you.

3. When do we share your personal data?

3.1 Sharing your personal data with third parties

When you browse the Site, your personal data may be transmitted to external service providers. These third parties provide a service on our behalf and in our name to ensure the proper functioning of credit card payments and other Services (including delivery of the Products).

Personal data may be transferred to countries outside the European Union for the purpose of fulfilling the relevant order and delivering the Products to you.

In this case, we take the necessary measures (contractual or otherwise) to ensure that the respective recipients of your data guarantee a level of data protection comparable to that of the European Union.  

Except in the event that a third party asks you to accept a privacy policy and its own terms of use, the third party companies that have received your personal data have undertaken to process your personal data solely for the purpose of implementing our Services.

3.2. Sharing with the authorities

We may disclose your personal data to administrative or judicial authorities when such disclosure is necessary for the identification, arrest or prosecution of any individual likely to prejudice our rights, any other user or a third party. Finally, we may be legally required to disclose your personal data and cannot object in this case.

4. How long do we keep your personal data?

We will only keep your personal data for the duration of your registration on the Site, in order to ensure your identification when you connect to your Account and to allow the provision of the Services.

Thus, if you unsubscribe from the Site, your personal data will be deleted and only kept in the form of an archive for the purpose of establishing proof of a right or contract.

In any event, we will keep your personal data for no longer than is necessary for the purposes for which they are processed in accordance with the uses set out in this Charter and in compliance with laws and regulations.

 5. Access, correction or deletion of data

You are the only person who has provided us with the data in our possession, via the Site. You have rights concerning your personal data. In accordance with the regulations on the protection of personal data, in particular Articles 15 to 22 of the DGPS, after proving your identity, you have the right to request access to, rectification or deletion of your personal data from us.

7.Personal data protection

All the information we collect about you is used and protected in accordance with current data protection laws.

We have put in place technical and organisational security measures to ensure the security, integrity and confidentiality of all your personal data. The purpose of this is to prevent data from being distorted, damaged or accessed by unauthorised third parties. We ensure an appropriate level of security; taking into account the state of knowledge, the costs of implementation and the nature, scope, context and purposes of the processing operation as well as the risks and their probability.

Your personal information is stored on secure networks and is only accessible to a limited number of people who have special access rights and are required to keep the information confidential. The server of Corthay's website is located in France.

However, it is specified that since no security measure is infallible, we are not in a position to guarantee absolute security of your personal data.

In addition, you are responsible for maintaining the confidentiality of the password used to access your Client Account. Do not share this information with anyone. If you share your computer, remember to log out before leaving a Service
